NEW PUBLICATION GUIDELINES FOR RESOLUTIONS ON THE INDECOPI WEBSITE

On February 22, 2023, Law 31692 – LAW THAT GUARANTEES THE PUBLICATION OF THE RESOLUTIONS OF THE NATIONAL INSTITUTE FOR THE DEFENSE OF COMPETITION AND THE PROTECTION OF INTELLECTUAL PROPERTY (INDECOPI) was published in the Official Gazette of Peru. The decision-making bodies have the obligation to publish their resolutions on the institutional website within a maximum period of 30 calendar days, once these are notified to all the parties, except when the case is of confidential or reserved content. This law will enter into force 60 calendar days after its publication. Officials or public servants who fail to comply with the deadlines and terms will be committing a serious disciplinary offense. Regarding the resolutions that were notified before the entry into force of this law, the decision-making bodies have a non-extendable term of 180 business days, counted from its entry into force, to publish the resolutions on the institutional website.

Legal certainty is what allows us better control of administrative cases and an increase in confidence towards our institutions.
